ACCEPTANCE
Macquarie Group Services Pty Limited ("MGS") makes available for your use on this website (the "Site") information, documents and products (collectively, the "Materials"), subject to the terms and conditions set out in this document (the "Terms & Conditions"). By accessing or using this Site, including any of the services we provide ("Services"), you agree to these Terms & Conditions. MGS may change these Terms & Conditions from time to time at its sole discretion. Your use of the Site will be subject to the most current version of the Terms & Conditions posted on the Site at the time of such use. In addition, the use of particular Materials or Services may be subject to any additional posted guidelines or rules applicable to such Materials or Services in addition to these Terms & Conditions. All such guidelines or rules are hereby incorporated by reference into these Terms & Conditions. If you breach any of these Terms & Conditions, your authorisation to use this Site automatically terminates.
USE OF SITE INFORMATION
Except as otherwise indicated elsewhere on this Site, you may view, download and print the Material on this Site subject to the following conditions: The Material may not be modified or altered in any way; The Material may not be distributed; You may not remove any copyright or other proprietary notices contained in the Material; MGS reserves the right to revoke the authorisation to view, download and print the Material at any time, and any such use shall be discontinued immediately upon written notice from MGS; and The rights granted to you constitute a licence and not a transfer of title. The rights specified above to view, download and print the Material are not applicable to the design or layout of this Site. Elements of this Site are protected by trade and other laws and may not be copied or imitated in whole or in part.
LICENCE FOR USER CONTENT
Certain Materials and Services offered on this Site accommodate or require user-supplied information, materials or communications (collectively, 'User Content'). By submitting User Content to this Site, such as comments to the Members Forum or product suggestions, you grant MGS an unrestricted, worldwide, irrevocable licence to use, reproduce, display, perform, modify, transmit and distribute such User Content, and you also agree that MGS is free to use any ideas, concepts, know-how or techniques that you send us for any purpose. However, we will not release your name nor that of any other party or otherwise publicise the fact that you submitted such User Content to us unless: (a) you grant us permission to do so; (b) we first notify you that the User Content you submit to a particular part of the Site will be published or otherwise used with your name or that of another party on it; or (c) we are required to do so by law.
GOVERNING LAW AND JURISDICTION
This Site (excluding linked sites) is controlled by MGS from its office within the state of New South Wales, Australia. By accessing this Site, you and MGS agree that all matters relating to your access to, or use of, this Site shall be governed by the statutes and laws of New South Wales and Australia. MGS makes no representation that Materials or Services available on this Site are appropriate or available for use in other locations, and accessing them from jurisdictions where their contents are illegal is prohibited. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with local laws.
INDEMNITY
You agree to indemnify and hold MGS, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of content you submit, post to or transmit through the Site (including, without limitation, any User Content), your use of the Site, your connection to the Site, your violation of the Terms & Conditions, or your violation of any rights of another person or entity.
MEMBERS FORUM
Your access to the Members Forum will be denied for violation of the prohibitions set forth in these Terms & Conditions under the section entitled PROHIBITED COMMUNICATIONS.
MANAGING USER CONTENT AND COMMUNICATIONS
MGS reserves the right, in its sole discretion, to delete or remove your User Content from the Site and to restrict, suspend or terminate your access to all or part of this Site, at any time for any reason without prior notice or liability.
MGS may establish general practices and limits on the use of any Materials and Services, including, but not limited to, limits on retention time, file size, and storage space for User Content. MGS shall have no liability or responsibility for the deletion or failure to store any information or materials in connection with any Materials and Services.
MGS may, but is not obligated to, monitor or review (i) any areas on the Site where users transmit or post User Content, including but not limited to areas where Materials and Services are available, or the Members Forum, and (ii) the substance of any User Content.
To the maximum extent permitted by law, MGS will have no liability related to User Content arising under the laws of copyright, libel, privacy, obscenity, or otherwise. MGS also disclaims all liability with respect to the misuse, loss, modification, or unavailability of any User Content.
PROHIBITED COMMUNICATIONS
You may only submit to the Site, User Content that is (a) owned by you, (b) submitted with the express permission of the owner, or (c) in the public domain. You are prohibited from posting or transmitting to or from this Site any unlawful, threatening, libelous, defamatory, obscene, pornographic, or other materials that would violate any law or the rights of others, including without limitation, laws against copyright infringement. USE AND PROTECTION OF MEMBERSHIP NUMBER AND PASSWORD
MGS takes all reasonable care to protect the confidentiality of your registration/subscriptions and credit card details. Similarly, you are responsible for maintaining the confidentiality of your registration/subscriptions and passwords, and for all uses of your credit card details provided to MGS, whether or not actually or expressly authorised by you. If you provide your credit card details to MGS, we reserve the right to debit that card for all future credit card purchases of our Materials and Services made by you.
PERSONAL INFORMATION AND PRIVACY
MGS is the sole owner of the information collected on the Site, and takes reasonable steps to ensure that it is accurate, complete and up-to-date. MGS will not sell, share, rent or otherwise use or disclose this information to others in ways different from what is disclosed in these Terms and Conditions and/or authorised or required by law.
In order to use certain sections of the Site, a user must first complete a registration/subscription application form. During the making of such an application, a user is required to give their contact information (such as name and email address). This information can also be used to contact the user about the Materials and Services on the Site for which they have expressed interest.
We request information from the user on our order forms. Here a user must provide contact information (like name and mailing address) and financial information (like credit card number and expiration date). This information is used for billing purposes and to fill users' orders. If we have trouble processing an order, this contact information is used to get in touch with the user.
By proceeding with a registration/subscription application and/or an order, a user of the Site is taken to have consented to the use of information collected on a registration/subscription application form and/or an order form for the purposes of direct marketing by MGS.
With both the information collected on a registration/subscription application form and an order form, the provider of the information may be entitled to gain access to that information by contacting MGS. MGS may take action to advise an individual of the contents of these Terms & Conditions, if information collected on a registration/subscription application form and/or an order form relates to but was not provided by them.
We use Internet Protocol (IP) addresses to analyse trends, administer the Site, track user's movement, and gather broad information for aggregate use. IP addresses are not linked to personally identifiable information.
We may share aggregated information with our business partners. This is not linked to any personal information that can identify any individual person.
The Site contains links to other websites. Please be aware that MGS is not responsible for the privacy practices of such other websites. We encourage our users to be aware when they leave the Site to read the privacy statements of each and every website that collects personally identifiable information. This privacy statement applies solely to information collected by the Site.
MGS takes reasonable steps to protect personal information held from misuse and unauthorised access, modification and/or disclosure, whether it has been submitted and/or held by MGS online or off-line. MGS takes reasonable steps to destroy or permanently de-identify personal information held, if it is no longer needed for any purpose for which the information may be used or disclosed under these Terms & Conditions.
When our registration/subscription application and order forms ask users to enter sensitive information (such as a credit card number), that information is encrypted and is protected with Secure Sockets Layer (SSL) encryption software. The transfer of sensitive information from your machine to the MGS server is made using the SSL protocol with 128-bit encryption.
All use of our users' information is restricted to authorised personnel. Only those employees and contractors who need the information to perform a specific job (eg. accounts staff) are granted access to personally identifiable information.

Except as expressly provided otherwise in any written agreement between you and MGS, all Materials and Services are provided "as is" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability or fitness for a particular purpose, or the warranty of non-infringement. To the extent permissible, any implied warranties are limited to ninety (90) days.
MGS may make changes to the Materials and Services at this Site, including the prices and descriptions of any Materials and Services offered herein, at any time without notice.
References to other entities, their services and products, are provided "as is" without warranty of any kind, either express or implied.
You agree that neither MGS nor its suppliers will be liable to you or any third party for any damages of any kind, whether in contract or in tort or otherwise, resulting from your use of the Site, Materials or Services.
The use of the Materials or Services or the downloading or other acquisition of any Materials or Services through the Site is done at your own discretion and risk and with your agreement that you will be solely responsible for any damage to your computer system or loss of data that results from such activities. This Site contains links to third-party websites that are not under the control of MGS. MGS makes no representations whatsoever about any other website to which you may have access through this Site. When you access a non-MGS website, you do so at your own risk and MGS is not responsible for the accuracy or reliability of any information, data, opinions, advice, or statements made on these sites or for the quality of any products or services available on such sites. MGS provides these links merely as a convenience and the inclusion of such links does not imply that MGS endorses or accepts any responsibility for the content or uses of such websites.
